These Terms of Service ("Terms") govern your use of the website, applications, and services provided by Neat Media House LLC ("Company," "we," "us," or "our"). By accessing or using our website, the Neat Portal, our communications, or any of our services, you agree to these Terms. If you do not agree, do not use our services.
1. Services
Neat Media House provides creative and marketing services including, but not limited to:
Video production
Photography
Social media management
Content creation
Email marketing
SMS / text message marketing
Website design and development
Client analytics and reporting (via the Neat Portal)
Live event production
Podcast production
All services are subject to individual agreements, proposals, or contracts. In the event of a conflict, the signed agreement takes precedence over these Terms.
2. Use of Website
You agree to use this website only for lawful purposes. You may not:
Use the site in a way that violates any laws or regulations
Attempt to gain unauthorized access to systems or data
Interfere with the website's functionality or security
We reserve the right to restrict or terminate access at our discretion.
3. Live Chat
We may offer a live chat feature on our website to assist visitors and clients.
Live chat is provided for convenience and is not monitored 24 hours a day; responses may be delayed
Conversations may be recorded, logged, and stored to improve our services and for quality and training purposes
You agree not to submit unlawful, abusive, or harassing messages through the chat
Do not share sensitive personal information (such as passwords, payment card numbers, or government identifiers) through live chat
Information provided through live chat does not create a contract or guarantee of services unless confirmed in a signed agreement
4. Intellectual Property
All content on this website, including but not limited to:

Images
Videos
Graphics
Branding and logos
Software, code, and the design of the Neat Portal
is the property of Neat Media House unless otherwise stated. You may not reproduce, distribute, or use any content without written permission.
5. Client Work and Deliverables
Ownership and usage rights for client work are defined in each individual contract. Unless otherwise stated:
Final deliverables are licensed, not sold
Neat Media House retains the right to use work for portfolio, marketing, and promotional purposes
Raw files are not included unless explicitly agreed upon
6. Marketing Services and Regulatory Compliance
When we provide email marketing, SMS / text marketing, or similar communication services on behalf of a client, the client is responsible for ensuring that:
All contact lists, phone numbers, and email addresses were collected lawfully and with the appropriate consent
Required opt-in consent has been obtained before any marketing message is sent, in compliance with applicable laws including the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and carrier and platform requirements (including A2P 10DLC registration where applicable)
Recipients are provided a clear and functional method to opt out of future messages
The client agrees to indemnify and hold Neat Media House harmless from any claims, penalties, or damages arising from contact data, consent, or message content the client provides or directs us to use. We may decline to send any campaign we reasonably believe violates applicable law or platform policy.
7. Email and Text Message Communications
If you subscribe to, opt in to, or otherwise provide your email address or mobile number to Neat Media House, you consent to receive communications from us as described below.
By subscribing, you consent to receive marketing and informational emails from us
Every marketing email includes an unsubscribe link, and we honor opt-out requests promptly
You may unsubscribe at any time without affecting any active service agreement
Text / SMS
By providing your mobile number and opting in, you consent to receive recurring marketing and informational text messages from Neat Media House
Consent to receive text messages is not a condition of purchasing any goods or services
Message frequency varies
Message and data rates may apply
Reply STOP at any time to unsubscribe, or HELP for assistance
Mobile carriers are not liable for delayed or undelivered messages
We will not sell your phone number or email address to third parties. Your information is handled in accordance with our Privacy Policy.
8. Payments and Billing
Payment terms are outlined in each project agreement. General terms may include:
Deposits required before work begins
Late payments may result in paused or delayed services
Final deliverables may be withheld until payment is complete
All payments are non-refundable unless otherwise stated in writing.
9. Revisions and Approvals
Projects include a defined number of revisions as stated in your agreement.
Additional revisions may incur extra charges
Client approval is required at key stages
Once approved, changes may be treated as a new scope of work
10. Scheduling and Cancellations
Scheduling is subject to availability
Cancellations or rescheduling may be subject to fees
No-shows or last-minute cancellations may result in forfeited deposits
Specific terms will be outlined in your agreement.
11. Neat Portal (Client Dashboard)
The Neat Portal is a private, account-based dashboard that we make available to active clients and authorized users for analytics, reporting, content access, and related features.
Access is granted at our discretion and limited to clients and users we authorize
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account
You agree to notify us promptly of any unauthorized access or suspected security breach
You may not share access, attempt to access another account, scrape, reverse engineer, or interfere with the portal or its underlying systems
Analytics and metrics displayed in the portal are provided for informational purposes only. Much of this data is sourced from third-party platforms (such as Meta, Instagram, Facebook, Google, and YouTube) and may be delayed, incomplete, or subject to change by those platforms
We do not guarantee uninterrupted or error-free access and may suspend the portal for maintenance, updates, or other operational reasons
We may modify, limit, suspend, or revoke portal access at any time, including upon termination of services or violation of these Terms
12. Limitation of Liability
To the fullest extent permitted by law, Neat Media House shall not be liable for:
Indirect, incidental, or consequential damages
Loss of revenue, profits, or business opportunities
Delays or failures caused by events outside our control
Loss, inaccuracy, or unavailability of data displayed in the Neat Portal or sourced from third-party platforms
Delivery failures, delays, or carrier issues affecting email or text message communications
Our total liability shall not exceed the amount paid for the specific service. Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
13. Third-Party Platforms
We may use or integrate with third-party platforms such as:
Social media platforms (including Meta, Instagram, Facebook, YouTube, and TikTok)
Hosting and infrastructure providers
Payment processors
Email service providers
SMS / text messaging providers
Project management and workflow tools
We are not responsible for the performance, policies, availability, or outages of these platforms. Your use of any third-party platform may also be governed by that platform's own terms and privacy policies.
14. No Guarantees
While we aim to deliver high-quality results, we do not guarantee:
Specific marketing outcomes
Engagement, reach, deliverability, or conversions
Business growth or revenue increases
15. Termination
We reserve the right to terminate services if:
Terms are violated
Payments are not made
Communication breaks down or becomes unproductive
Staff are subjected to inappropriate, discriminatory, or abusive behavior
Any work completed up to termination remains billable.
16. Privacy
Your use of our website, the Neat Portal, and our communications is also governed by our Privacy Policy.
17. Changes to These Terms
We may update these Terms at any time. Updates will be posted on this page with a revised date.
18. Governing Law
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict of law principles.
